‘’CURRENT EVENTS AND PLAYERS IN UPCOMING AND CURRENT CRISES’’
This marks the beginning of the third phase of the class in which a variety of events and people of power will be scrutinized in light of and in connection to their involvement in upcoming and current crises, such as Climate Change, the National Surveillance State, and the Northern Industrial Alliance and its position in global politics.
The upcoming (June 5) papal encyclical on Climate Change and its inherent link to Trans-National Corporate Capitalism is discussed at length. Also discussed, is the concept of a Jubilee year, which will be mandated if there is a lack of global commitment to create legally binding, enforceable consequences to global warming by December 8 of this year.
A number of other scenarios are also discussed—including Bechtel Corporation and water rights in Bolivia, Shell Oil’s involvement in Nigeria, Dick Cheney and his connection to Halliburton, the Carlilsile Group and its connection to the Bush family and the invasion of Afghanistan, the International Monetary Fund and the World Bank, and many more.
This class serves as an introduction to the third phase of the class, fueling students’ desire to research one of these topics for their final paper.

In 2020, the Supreme Court surprised many observers by holding up the rights of the Muscogee (Creek) nation. In McGirt v Oklahoma, the Court held that the Creek Nation retained its sovereign rights over a very large part of Eastern Oklahoma. The decision began with a poetic line: “At the end of the Trail of Tears is a promise.” The case raises further interest in issues of Indian law, which includes a very important case on the docket this year on the issue of the adoption of Indian children without the consent of the tribe. Robert Miller and Robbie Ethridge have written a new book on the McGirt case, on the history of the Muscogee nation’s relations with the United States, and the details of the case itself. And the title of the book references that first line of the decision. It is called A Promise Kept: The Muscogee (Creek) Nation and McGirt v Oklahoma. Our guests are the authors of the book. In Part ONE: Bill Pepper became James Earl Ray’s lawyer when he found out that Ray was not the murderer. His friendship with King and his family goes back to 1967. Pepper had gone to Vietnam and taken photos of children burned by napalm. King asked to meet with him and they worked closely together during the anti-Vietnam war phase of King’s life.
After the failure of all his efforts to get James Earl Ray a new trial, William Pepper recommended one more option to the King family. In this Part TWO Pepper explains why he recommended a wrongful death suit against Loyd Jowers and other known and unknown conspirators. For the first time under oath in any assignation case there is the complete picture of how Martin Luther King was killed. It took the jury 59 minutes to come back with a verdict against Loyd Jowers and an award for the family.
There is a summary of the outcome – as well as 4,000 pages of transcripts posted on the King Center web site. Here is what Coretta Scott King said about the case: “After four weeks of testimony and over 70 witnesses in a civil trial in Memphis, Tennessee, twelve jurors reached a unanimous verdict on December 8, 1999 after about an hour of deliberations that Dr. Martin Luther King, Jr. was assassinated as a result of a conspiracy.’’ In a press statement held the following day in Atlanta, Mrs. Coretta Scott King welcomed the verdict, saying , “There is abundant evidence of a major high level conspiracy in the assassination of my husband, Martin Luther King, Jr. And the civil court’s unanimous verdict has validated our belief. I wholeheartedly applaud the verdict of the jury and I feel that justice has been well served in their deliberations. This verdict is not only a great victory for my family, but also a great victory for America. It is a great victory for truth itself. … The jury was clearly convinced by the extensive evidence that was presented during the trial that, in addition to Mr. Jowers, the conspiracy of the Mafia, local, state and federal government agencies, were deeply involved in the assassination of my husband.’’
The jury also affirmed overwhelming evidence that identified someone else, not James Earl Ray, as the shooter, and that Mr. Ray was set up to take the blame. I want to make it clear that my family has no interest in retribution. Instead, our sole concern has been that the full truth of the assassination has been revealed and adjudicated in a court of law… My husband once said, “The moral arc of the universe is long, but it bends toward justice.” To-day, almost 32 years after my husband and the father of my four children was assassinated, I feel that the jury’s verdict clearly affirms this principle. With this faith, we can begin the 21st century and the new millennium with a new spirit of hope and healing.

The FBI, the Federal Bureau of Investigation was once called by American Indian movement activist John Trudell, as the Federal Bureau of Intimidation. The FBI has a long history of persecuting people for thought crimes, having the wrong political ideas. J. Edgar Hoover was the Bureau’s first director and he served in that post for almost 50 years. He ran the FBI as an unchallenged lord of the manor and his agents were serfs to do his bidding. Hoover had a particular animosity for and loathing of Dr. Martin Luther King, Jr., the Nobel Peace Prize winner and leader of the Civil Rights movement. He called King “the most notorious liar in the country.” President Kennedy and his attorney general brother Robert signed off on Hoover’s request to wiretap Dr. King. Using infiltrators, the spread of rumors, the fabrication of evidence, and media manipulation, the FBI launched a full-scale smear campaign to discredit Dr. King and the movement he led. He saw in the divide between whites and Blacks, especially with the political ascendancy of Donald Trump and the far right, the same kind of deadly tribalism here, one that usually leads to internecine violence. He watched as other Somali families succumbed to the poison of American racism, writing that although they had survived the war in Africa, American broke them and carried them off. (5-14-2015): ‘’14th Amendment – Equal Protection of Law’’
This class focuses on the Equal Protection of Law provision in the first clause of the Fourteenth Amendment.
Five years after the ratification of the Fourteenth Amendment, the Slaughterhouse Cases determined that United States citizenship, and not state citizenship, would be affected by the Fourteenth Amendment, therefore, it would not restrict policing powers of the state. It was also determined that the Fourteenth Amendment was specifically intended to protect the rights of former slaves, therefore, undermining the broad intention of due process and equal protection of law. Because of this, progressives were forced to use selective inclusion of specific instances of protection under the due process of law provision of the Fourteenth Amendment.
Furthermore, because of the ruling of the Slaughterhouse Cases, the Equal Protection of Law provision could only be applied to former slaves so that the moderates had to, once again, determine conceptual devices to decide the parameters that would allow a group or individual equal protection of law. Such parameters are discussed at length.
Why did the court choose such a narrow definition of the Fourteenth Amendment with the ruling of the Slaughterhouse Cases? There is a discussion of the shift of consciousness that occurred with the presidential election of 1876 to explain this reactionary shift.
Professor Sheehan gives two examples of cases he litigated that were based on provisions of the Fourteenth Amendment: Silkwood v. Kerr-McGee and Morton v. Mancari.
This concludes the second part of the lecture series. Phase three will discuss how we apply the Constitution to create tools to confront upcoming issues: climate change, the rise of the national security state, and military conflict between the Northern Industrial Alliance and Asia.

How do algorithms govern social and political interactions? What is the most proper use of algorithms? And what are the biases that persist in their use? Empires rise and fall from Greek and Roman times down to the British and the French to the present-day U.S. Some lasted for centuries others mere decades. There are always new powers that want to rule the roost. For many, military power is closely linked to economic well-being. But once the cash register starts emptying overall decline is not far behind. It’s clear that in the 21st-century global dominance is a contest between the U.S. and China. Russia is dangerous but is relatively weak, witness its ineptitude in Ukraine. The National Intelligence Council is a top-level U.S. government agency that produces reports projecting global trends. Not surprisingly, it identifies Beijing as a “potential rival” to Washington that “will
probably have the largest economy, surpassing that of the U.S. a few years before 2030.”

Jim begins by relating Oliver Stone’s address to the Cannes Film Festival, following the screening of JFK Revisited.
Noting the evidentiary archives assembled and credentialed by the ARRB, he noted that “conspiracy theory” has become “conspiracy fact.”
Recorded on Veterans’ Day of 2022, we noted Oliver Stone’s own service as a decorated combat infantryman in Vietnam, and recapped how JFK was withdrawing the U.S. from Vietnam when he was killed.

More than ever, the victims and critics of the problems of 2022 identified them as symptoms of a systemic problem, namely the capitalist system. On the one hand, capitalism is working as it always has, but that is now a problem. The impulse is to silence opponents rather than engage in dialogue and debate. This extreme polarization, as Steven Levitsky and Daniel Ziblatt write in How Democracies Die, is one of the primary signs of a dying democracy. Nolan Higdon, a lecturer at Merrill College and the Education Department at University of California, Santa Cruz and Mickey Huff, the director of Project Censored and president of the nonprofit Media Freedom Foundation, join me to discuss this dangerous inability to communication among antagonistic groups and their new book Let’s Agree to Disagree: A Critical Thinking Guide to Communication, Conflict Management, and Critical Media Literacy.

Nothing is more important in the JFK investigation than the role of the media, the element we rely upon for our information. That distillate provides us with our basis for making intelligent, measured decisions.
In our long series of interviews with Mr. DiEugenio about his book Destiny Betrayed, we noted that the media have functioned closely with the intelligence services and other federal agencies to actively cover-up the truth.
The program begins with Jim’s review of the media’s role in the Garrison case.
Next, we synopsize the role of media vis a vis the Warren Report, including: Major networks and MSM print voices (NYT, WaPo) endorse report, despite the fact that the 26 volumes of testimony and exhibits had yet to be released; Warren Commissioner John J. McCloy’s CBS interview where he doesn’t answer Walter Cronkite’s query, nor does he mention that his daughter Ellen heavily liaised with network management on the program; Alec Baldwin’s experience with NBC, who wouldn’t let him book guests critical of the Warren Report and is told that NBC’s stance is to support the official version of the assassination (Tom Brokaw—“No Garrison”); Background on the Sarnoff family’s intelligence connections.
We then synopsize Life Magazine’s role in the cover-up, including: Though not discussed in JFK Revisited, it was Life that purchased Zapruder film and then re-arranged the still frames in its issue supporting Warren Report; Henry Luce’s role as enabler of the Powers That Be (his idol, BTW, was Mussolini); C.D. Jackson’s role with Life—though not discussed in film, he was a lifelong intel/national security player; Life’s publication of the cover photo of “Oswald” holding the rifle and pistol he supposedly used in the killings; Oswald’s wedding ring on different fingers of “Oswald’s” hand.
Next, we highlight key aspects of the rifle allegedly used by Oswald, including: The salient fact that in Texas (at that point in time) anyone could purchase a rifle over the counter without documentation; Why would anyone planning a political assassination purchase a mail-order rifle?; Different barrel lengths of “Oswald’s” rifle in various presentations; different mountings of sling on “Oswald’s” rifle in various presentations; The fact that mail order box wasn’t in Oswald’s name, so he couldn’t have received the weapon; the disparate time frames involved in sending the weapon through the mail.
We conclude with discussion of the rifle and forensics vis a vis its present on 6th floor “sniper’s perch,” including: The remarkably neat placement of the spent cartridges in the “sniper’s nest;” Reporter Tom Alyea’s discussion of how the “sniper’s perch” looked prior to apparent interference.

“Podcast with Helen Benedict and Eyad Awwadawnan on the effort’s by industrial nations to lock out 84 million forcibly displaced migrants around the globe”
There are some 84 million forcibly displaced people in the world, more than at any time since World War II. They are fleeing a combination of war, civil unrest, religious conflict, poverty, persecution, local violence and the climate crisis. As conditions worsen, authoritarian governments are on the rise that denounce immigrants and refugees as contaminants and impose draconian policies to turn them back, including at sea where whole boats of refugees are drowned. Pope Francis calls the Mediterranean “the largest cemetery in Europe. The persecution and abuse of refugees is becoming policy, including in Europe, Great Britain, Australia and the United States. It does not matter that the U.S. bears a direct responsibility for the more than 37 million people who have fled the wars in Iraq, Syria and Afghanistan since 2001, not to mention the U.S.-backed wars Central America. The U.S. proxy war in Ukraine has only exacerbated the crisis. The EU is providing money to Greece and Turkey to detain and prevent refugees from seeking asylum in other European countries. The EU is testing sound canons to blast at asylum seekers trying to cross into Greece from Turkey. The coast guards of Greece and the EU push refugees – including children – back out to sea, causing many to drown. Greece, which imprisons seven out of ten asylum seekers, denies new arrivals, including Afghans, the right to request asylum, unless these arrivals are Ukrainians. The increased hostility to refugees in the United States, Great Britain, Italy, Belarus, Poland, Croatia, Greece, Spain and Hungary are the building blocks of a new and heartless world order, once where the wealthy industrialized nations of the earth wall off the destitute to suffer and die. Joining me to discuss the crisis is Helen Benedict, who with Eyad Awwadawnan, wrote Map of Hope and Sorrow: Stories of Refugees in Greece.

Nothing is more important in the JFK investigation than the role of the media, the element we rely upon for our information. That distillate provides us with our basis for making intelligent, measured decisions.
In our long series of interviews with Mr. DiEugenio about his book Destiny Betrayed, we noted that the media have functioned closely with the intelligence services and other federal agencies to actively cover-up the truth.
The program begins with Jim’s review of the media’s role in the Garrison case.
Next, we synopsize the role of media vis a vis the Warren Report, including: Major networks and MSM print voices (NYT, WaPo) endorse report, despite the fact that the 26 volumes of testimony and exhibits had yet to be released; Warren Commissioner John J. McCloy’s CBS interview where he doesn’t answer Walter Cronkite’s query, nor does he mention that his daughter Ellen heavily liaised with network management on the program; Alec Baldwin’s experience with NBC, who wouldn’t let him book guests critical of the Warren Report and is told that NBC’s stance is to support the official version of the assassination (Tom Brokaw—“No Garrison”); Background on the Sarnoff family’s intelligence connections.
We then synopsize Life Magazine’s role in the cover-up, including: Though not discussed in JFK Revisited, it was Life that purchased Zapruder film and then re-arranged the still frames in its issue supporting Warren Report; Henry Luce’s role as enabler of the Powers That Be (his idol, BTW, was Mussolini); C.D. Jackson’s role with Life—though not discussed in film, he was a lifelong intel/national security player; Life’s publication of the cover photo of “Oswald” holding the rifle and pistol he supposedly used in the killings; Oswald’s wedding ring on different fingers of “Oswald’s” hand.
Next, we highlight key aspects of the rifle allegedly used by Oswald, including: The salient fact that in Texas (at that point in time) anyone could purchase a rifle over the counter without documentation; Why would anyone planning a political assassination purchase a mail-order rifle?; Different barrel lengths of “Oswald’s” rifle in various presentations; different mountings of sling on “Oswald’s” rifle in various presentations; The fact that mail order box wasn’t in Oswald’s name, so he couldn’t have received the weapon; the disparate time frames involved in sending the weapon through the mail.
We conclude with discussion of the rifle and forensics vis a vis its present on 6th floor “sniper’s perch,” including: The remarkably neat placement of the spent cartridges in the “sniper’s nest;” Reporter Tom Alyea’s discussion of how the “sniper’s perch” looked prior to apparent interference.

There are some 84 million forcibly displaced people in the world, more than at any time since World War II. They are fleeing a combination of war, civil unrest, religious conflict, poverty, persecution, local violence and the climate crisis. As conditions worsen, authoritarian governments are on the rise that denounce immigrants and refugees as contaminants and impose draconian policies to turn them back, including at sea where whole boats of refugees are drowned. Pope Francis calls the Mediterranean “the largest cemetery in Europe. The persecution and abuse of refugees is becoming policy, including in Europe, Great Britain, Australia and the United States. It does not matter that the U.S. bears a direct responsibility for the more than 37 million people who have fled the wars in Iraq, Syria and Afghanistan since 2001, not to mention the U.S.-backed wars Central America. The U.S. proxy war in Ukraine has only exacerbated the crisis. The EU is providing money to Greece and Turkey to detain and prevent refugees from seeking asylum in other European countries. The EU is testing sound canons to blast at asylum seekers trying to cross into Greece from Turkey. The coast guards of Greece and the EU push refugees – including children – back out to sea, causing many to drown. Greece, which imprisons seven out of ten asylum seekers, denies new arrivals, including Afghans, the right to request asylum, unless these arrivals are Ukrainians. The increased hostility to refugees in the United States, Great Britain, Italy, Belarus, Poland, Croatia, Greece, Spain and Hungary are the building blocks of a new and heartless world order, once where the wealthy industrialized nations of the earth wall off the destitute to suffer and die. Joining me to discuss the crisis is Helen Benedict, who with Eyad Awwadawnan, wrote Map of Hope and Sorrow: Stories of Refugees in Greece.
